El
sistema registral paraguayo regula formas de publicidad de los Derechos
Reales sobre los bienes inmuebles a través de los Registros Públicos,
cuyas normas, así como la organización de la Institución, se hallan
contempladas en el Código de Organización Judicial. Este Sistema no
constituye adquisición del dominio y demás Derechos Reales
inmobiliarios, careciendo el Registro de efectos constitutivos por lo
que los actos y contratos que no hayan sido inscriptos no pueden tener
validez contra terceros, es decir, no son oponibles. Asimismo, la
constitución de los Derechos Reales está completamente desvinculada de
las formas de publicidad. La publicidad registral de los Derechos Reales
inmobiliarios -entendida como la divulgación de una situación jurídica a
objeto de provocar su conocimiento general- no es eficaz hasta que se
haya practicado el asiento registral correspondiente. El Registro no
limita su efectividad a la simple publicidad y a la oponibilidad frente a
terceros de los actos inscriptos, sino que posee efectos convalidantes a
partir de dicha inscripción.
